Court Rules in Favor of ACH in Landmark Case: Judgment Overturns Jury Verdict and Vacates $770,000 Judgment
(Franklin, TN) - In a significant legal victory, Advanced Correctional Healthcare, Inc. (ACH) is proud to announce that United States District Judge Ludington of the Eastern District of Michigan issued an Opinion and Order ruling in favor of ACH and the health care staff.
The court determined that the evidence presented at trial was insufficient to support the jury’s verdict. Judge Ludington emphasized the lack of evidence supporting the Plaintiff's claim required that the Court not only overturn the verdict but enter judgment in favor of the company.
This ruling is particularly notable as it overturns a jury verdict—a rare occurrence. Jury verdicts are afforded significant weight, but in this case, the Judge determined the “proof is all one way or so overwhelmingly preponderant in favor of [ACH] as to permit no other rational conclusion.”
